- The permit is issued by the Minister of the Interior and Administration — the application is filed in Warsaw in person, by post or via a representative.
- Stamp duty: 1,570 zł (+ 17 zł for a power of attorney).
- A promise (commitment to issue the permit) is valid for 1 year.
- Flats outside the border zone do not require a permit.
When a permit is required
A citizen of a country outside the EU, EEA and Switzerland needs a permit to buy a house with land, a building plot or farmland, commercial premises, or a flat in the border zone. It also covers shares in companies that own property in Poland.
When it isn't
- A separate flat (outside the border zone).
- A garage or parking space for housing needs.
- 5 years after receiving a permanent residence or EU long-term resident card.
- Spouse of a Polish citizen: 2 years after the card, buying as joint property.
- Buying from a relative whose statutory heir you are, if they owned the property for at least 5 years.
How the procedure works
- We check the property and sign a preliminary contract conditional on the permit.
- We compile the application: property details (land register, land registry extract), purpose of purchase, your ties to Poland (residence card, job, company, family).
- You pay 1,570 zł stamp duty and we file the application with MSWiA.
- MSWiA may ask other bodies, such as the Minister of Defence, for an opinion — a decision usually takes 1–3 months.
- After the decision you sign the notarial deed.
MSWiA assesses whether the purchase threatens security or public order and whether you have ties to Poland.
