- You can read a land register for free at ekw.ms.gov.pl — you only need its number.
- The key parts are section II (owner), III (easements, claims) and IV (mortgages).
- The seller provides certificates of no debts and no registered occupants before the deed.
- The checklist below helps you not miss anything.
Land register — what each section means
- Section I-O: property description, area, address.
- Section I-Sp: rights attached to ownership, e.g. share of the land.
- Section II: owner — must match the seller (all co-owners).
- Section III: easements, claims, warnings, bailiff enforcement.
- Section IV: mortgages — the seller pays them off from the price; the bank's consent to removal is needed.
Seller's documents
- Title: notarial deed, inheritance decision, gift agreement.
- Certificate of no arrears in service charges (wspólnota or spółdzielnia).
- Certificate of no registered occupants.
- Energy performance certificate — mandatory when selling.
- For an inheritance within the last 5 years — a tax office certificate on inheritance tax.
Watch out for
- Cooperative ownership right without a land register — can be bought, but the bank may have conditions.
- Sale through a representative — we verify the power of attorney with the notary.
- An inherited flat with an incomplete estate division.
- A building due for demolition or in a road project zone.
- A price clearly below market — always a reason to ask questions.
